1. Provider and scope
These Terms govern the EURepNow service provided by European District LDA. The service is intended primarily for organisations seeking an EU representative under Article 27 GDPR.
2. Eligibility
Access to representation is subject to the information supplied by the client, EURepNow eligibility and risk checks, geographic coverage and, where necessary, manual review. EURepNow may request additional information before accepting or activating a mandate.
3. Client information
The client must provide complete, accurate and current information, including the information reasonably required for the written mandate, Article 30 records and communications with data subjects or supervisory authorities.
4. Representation service
Once the applicable fee has been paid, onboarding completed, the written mandate accepted and required publication steps completed, EURepNow records the representation as active. The precise scope is defined by the mandate and service purchased.
5. Fees and duration
Prices, billing period and any renewal terms are displayed before checkout. The selected commercial terms form part of the order. Taxes may apply according to the client's circumstances and applicable law.
6. Payment and activation
Payment alone does not override eligibility or onboarding requirements. Representation becomes active only when the client dashboard confirms active status.
7. Client responsibilities
The client remains responsible for its own GDPR compliance, processing activities, notices, responses and instructions, and must promptly inform EURepNow of material changes affecting the mandate.
8. Suspension and termination
EURepNow may suspend or terminate the service where payment is overdue, information is materially inaccurate, the service is misused, legal or sanctions concerns arise, or continued representation would be unlawful or outside the agreed scope. Consequences of termination will be handled according to the contract and applicable law.
9. Liability
EURepNow performs the contracted representative service with reasonable professional care. Nothing in these Terms excludes liability that cannot lawfully be excluded. The client remains responsible for its own acts, omissions and GDPR compliance.
10. Electronic records
The parties agree that electronic account records, acceptance logs, payment records and electronic acceptance of the mandate may be retained as evidence of the transaction and service relationship.
11. Applicable law and disputes
Subject to mandatory rules that may apply, these Terms are governed by Portuguese law. Jurisdiction: Portugal.
